How Machinery Reg penalties work

The EU Machinery Regulation delegates penalty setting to Member States. Penalties must be effective, proportionate, and dissuasive, and must take into account the degree of risk posed by non-compliant machinery. Market surveillance authorities can order withdrawal, recall, or prohibition of machinery from the market, in addition to financial penalties.
