How Green Claims penalties work
The proposed Green Claims Directive (COM(2023) 166) would require Member States to set maximum penalties of at least 4% of annual turnover for non-compliance with substantiation and verification requirements. As of May 2026, the Directive is still in trilogue negotiations; some elements of greenwashing enforcement are already active under the Empowering Consumers Directive (EU) 2024/825.
