How CS3D penalties work

CSDDD (Article 27) requires Member States to set maximum penalties of at least 5% of net worldwide turnover for the largest non-compliant companies. Civil liability is also provided for damage caused by breaches of due diligence obligations. This is the highest turnover-based minimum floor of any EU regulation, reflecting the severity of human rights and environmental violations.

What is the maximum CSDDD fine?

The CSDDD sets a minimum floor: Member States must set maximum penalties of at least 5% of net worldwide turnover. Some Member States may exceed this floor. Civil liability for actual damage caused has no cap.

Who does CSDDD apply to?

CSDDD applies to EU companies with more than 1,000 employees and more than €450M net worldwide turnover, and non-EU companies with more than €450M EU-generated net turnover. Application is phased by company size between 2027 and 2029.
