MiCA — asset-referenced token (ART) and e-money token (EMT) issuers must comply

Titles III and IV of MiCA apply from 30 June 2024. Issuers of asset-referenced tokens (ARTs) and e-money tokens (EMTs) must obtain authorisation from national competent authorities, publish compliant whitepapers, and meet capital, governance, and custody requirements.

Applies to: issuers of asset-referenced tokens and e-money tokens seeking to offer to EU public or seek admission to trading

Penalty: up to €5M or 3% of annual turnover; withdrawal of authorisation

MiCA full application — crypto-asset service providers (CASPs) must be authorised

Full MiCA application: Crypto-asset service providers (exchanges, custodians, advisors, portfolio managers, transfer services) must obtain a CASP licence from a national competent authority. Existing authorised entities have an 18-month transition period until June 2026.

Applies to: crypto-asset service providers operating in the EU; existing obligated entities under national crypto-asset frameworks (transition applies)

Penalty: up to €5M or 3% of annual turnover (CASPs); up to €700,000 for natural persons
