Data Act enters into force

The Data Act enters into force 20 days after publication in the Official Journal (OJ L, 22 December 2023). Most substantive obligations apply 20 months later.

Applies to: manufacturers of connected products and related service providers; data holders; data recipients; public sector bodies; cloud and data processing service providers

Penalty: up to €10M or 2% of worldwide annual turnover; up to €1M or 0.1% for making data available to public sector bodies

Data Act most provisions apply — data access rights and B2B/B2G obligations

20 months after entry into force: Core obligations apply including user rights to access product-generated data, B2B data sharing obligations, B2G data access for public emergencies, and unfair contractual terms protections.

Applies to: manufacturers and related service providers of connected products; data holders; public sector bodies requesting data in exceptional need

Penalty: up to €10M or 2% of worldwide annual turnover

Data Act cloud switching provisions and interoperability requirements apply

44 months after entry into force: Cloud and data processing service providers must enable customer switching within 30 days, remove all egress fees for switching or porting data, and comply with interoperability standards.

Applies to: cloud and edge computing service providers (IaaS, PaaS, SaaS) operating in the EU

Penalty: up to €10M or 2% of worldwide annual turnover
