# GDPR Fine Calculator

Estimate the indicative GDPR administrative-fine band for a given infringement. Implements the Article 83(2) factors and the EDPB Guidelines 04/2022 methodology — the same framework supervisory authorities use to set the actual fine. Runs entirely in the browser; no data leaves the device. Indicative only; not legal advice.

## How are GDPR fines calculated under Article 83?

GDPR fines are set by the supervisory authority on a case-by-case basis using the eleven Article 83(2) factors. The cap depends on the article infringed — €10M or 2% of global turnover for procedural duties (Art. 83(4)), €20M or 4% for core-principle and rights breaches (Art. 83(5)). The EDPB Guidelines 04/2022 set the five-step methodology authorities use.

1. **Categorise the infringement** — Identify the applicable cap (Art. 83(4) — lower tier — or Art. 83(5) — upper tier).
2. **Set the starting amount** — Based on the seriousness of the infringement (Art. 83(2)(a) — nature, gravity, duration).
3. **Adjust for circumstances** — Apply aggravating or mitigating circumstances under Art. 83(2)(b)–(k) — intentional/negligent character, mitigation, responsibility, prior infringements, cooperation, categories of data, manner of disclosure, codes/certifications, financial benefits or losses avoided.
4. **Apply the statutory maximum cap** — Higher of the fixed amount (€10M/€20M) or the turnover percentage (2%/4%).
5. **Apply effectiveness, proportionality, dissuasiveness** — Per Art. 83(1) — the final fine must satisfy all three properties.

## Calculator inputs

- **Turnover** — annual global turnover (preceding financial year). Used to apply the 2%/4% turnover cap. Single-undertaking for an undertaking; consolidated for a group acting as a single undertaking.
- **Tier** — Lower tier (Art. 83(4)): procedural duties (records, DPO designation, breach notification). Upper tier (Art. 83(5)): core principles, data subject rights, international transfers.
- **Severity (Art. 83(2)(a))** — Minor / Moderate / Severe. Reflects number of data subjects, sensitivity, prolonged exposure.
- **Cooperation (Art. 83(2)(f))** — Full (proactive, timely disclosure) / Partial (responsive but reactive) / None (obstructive or silent).
- **Prior infringements (Art. 83(2)(e))** — None on record / One prior / Multiple priors.

## Calculator output

Indicative fine band (low – high) around a midpoint, capped by the applicable statutory maximum. Calculation: statutory cap × severity multiplier × cooperation factor × prior-infringement factor, with ±45% band around the midpoint.

Five of the eleven Article 83(2) factors are modelled directly (tier, severity, cooperation, priors, turnover cap). The remaining six (intentional vs negligent character, manner in which the authority became aware, actions to mitigate damage, degree of responsibility, categories of data, adherence to codes/certifications) are not captured — the ±45% band acknowledges this uncertainty.
