# Directive (EU) 2023/970 of the European Parliament and of the Council to strengthen the application of the principle of equal pay for equal work or work of equal value between men and women through pay transparency and enforcement mechanisms

The EU's pay transparency law. Requires employers to disclose pay information to job applicants and employees, conduct pay gap reporting (for organisations above size thresholds), and provide remedies for pay discrimination. Strengthens enforcement of the equal-pay principle in Article 157 TFEU.

## Who does Pay Transparency Directive apply to?

Applies to employers in both the public and private sectors. Pay-gap reporting obligations phase in by size: ≥ 250 employees from 7 June 2027; ≥ 150 from June 2027; ≥ 100 from June 2031.

## What are the penalties for Pay Transparency Directive non-compliance?

**Maximum fine:** Penalties set by national law — must be effective, proportionate, dissuasive; recital references penalties proportional to seriousness

- 2031-06-07 — Pay-gap reporting obligation extends to employers with ≥ 100 employees (Article 9)
